It integrates the theory and practice of a community with a shared future for mankind with the traditional Chinese cultural concept that harmony is most valuable which is an important value orientation for contemporary human society to deal with human, ethnic and international relations.

  • The Determination of Excessive Defense by Judicial Practice and Its Rethinking——Based on an Analysis of 722 Criminal Judgments

    Concerning the determination of excessive defense,the main problems are the judicial practice of determining excessive defense only based on the resul of harm inflicted on a perpetrator;identifying excessive harm generally as an intentional crime;limiting the scope of exemption from punishmen of excessive defense relatively narrowly as well as repeated appraisals and indirect punishments.For the improvement of judicial determination of excessive defense,the following efforts should be made.First,from the perspective of ex ante,determining the necessary limits as the standard of whether the act of defense was necessary to stop unlawful infringement Second,paying due attention to the influence of the awareness of defense on the form of culpability and in general circumstances determining excessive defense as a negligent crime.Third,giving sufficient consideration of the extent to which the possibility of anticipation decreased when the defender was faced with unlawful infringement and expanding the scope of exemption from punishment for excessive defense.Fourth,avoiding repeated appraisals and indirect punishments by analyzing the factual grounds and essentia foundations of the circumstances of lesser or greater punishments.

  • Study of the Development of Chinese sports Industry in the Context of Supply-side Structura Reform

    In recent years,China’s sports industry has witnessed rapid development gradually forming an emerging strength in its Supply-side Structural Reform and thus increasingly being highlighted in the development of the nationa economy.Being integrated,society-based,green and sustainable,the sports industry is gaining popularity among the Chinese people.This paper studies the overall development of Chinese sports industry during the 12th FiveYear Plan period(2011-2015)and unveils the key achievements it made,such as the expansion of scale,the diversification of products and services,the improvement of industry policies,the apparent upgrading and optimization of the industry’s structure and its further integration with the Internet However,there are still some problems in the development of China’s sports industry&Chinese sports industry accounts for a fairly low proportion in the gross domestic product(GDP)and cannot yet compare with those of developed countries.Besides,given that its the sports services make up only a small share and that a supply-demand imbalance still exists in the sports products and services,its industrial structure requires further upgrading and optimization.In addition,failure to fully stimulate an innovation initiative restricts this industry’s further development.Targeting the bottleneck facing Chinese sports industry and corresponding path selection,this paper mainly analyzes its institutional mechanism reform,structural upgrading and layout product quality improvement and talent supply optimization.Based on the analysis,it is concluded that the development of Chinese sports industry is of great importance to China’s economic transformation,upgrading and healthy development and it echoes the call of Supply-side Structural Reform.

  • Gu Jiegang’s “Discussion of Ancient History” Movement and It Relationship with Developments in Western Sinology

    The scholarship in modern China is closely related to Western sinology in terms of school ties.Gu Jiegang’s launching of the"Discussion of Ancient History"movement centered on the"theory of the accumulated creation of Chinese ancient history"was a representative example.At the beginning of the movement Hu Shi and Gu Jiegang proposed the notion that,"there was no history before the Eastern Zhou Dynasty"which was indebted to the historical skepticism by Philip Van Ness Myers(American scholar)and Friedrich Hirth(German sinologist)of the same period.The idea that"the Shang Dynasty is still in the late Stone Age"advocated by Hu and Gu was also directly influenced by J.G.Andersson’s An Early Chinese Culture.Conversely,American sinologist Arthur W.Hummel Sr played a key role in introducing and evaluating the first volume of Discussion of Ancient History to Western academia.Paradoxically,while Swedish sinologis Bernhard Karlgren wrote On the Authenticity and Nature of the Tso Chuan to refute Kang Youwei’s reinterpretation of Confucian Classics(The Forged Classics of the Wang Mang Period),his work however became of value for Chinese historic doubt scholars to reaffirm the value of New Text Confucianism and advance the"Discussion of Ancient History"movement.If we would like to choose a saying to describe the relationship between the"Discussion of Ancien History"movement and Western Sinology,the Chinese proverb,"Stones from other hills may serve to polish jade of this one,"may be an appropriate choice.
